A Study on the Legal Relationship of Third Party Payment

Popis: | 107 With fast development of technology, there is a growing reliance on the Internet for commercial activities. As efficient as it is, trading on the Internet also holds some risks, such as deferred performance, imperfect performance and malicious fraud. The trustworthiness between the two parties is often questionable. In order to avoid these problems, third-party payment services were created. They aim to prevent commercial disputes by providing payment systems or Escrow contract. In the first part of this thesis, definitions and features of third-party payment services as well as the evolution of related laws are introduced. Third-party payment services are divided into different groups by their functions, and each group is described in detail in terms of their operating models and service contents. They are further exemplified by PayPal and Alipay, two popular third-party payment processors. Furthermore, the legal relationships between the third-party payment service providers and customers were deduced from the service contents of each group, specifically the rights and obligations between the parties. The discussions are based on fundamental theories and practical opinions. In addition, foreign legislation examples were also included. The examples consist of the existing laws and the evolution of regulations, from which the acquisition of a deeper and more complete understanding of third-party payment service regulations is expected. Finally, with all the legal interpretations above, the thesis is concluded with an attempt to propose a substantive law that is the most feasible to all groups of third-party payment services. By establishing well-defined relationships between third-party services processors and customers, a resolution to commercial disputes resulting from this new type of transaction might be achievable. |
