Popis: | 106 After 2008, FinTech firms were introduced into the financial industry with low operating costs, cloud technology, big data, and social media to improve the efficiency of financial ser-vice and transform the conventional financial infrastructures. FinTech brings considerable benefits of convenience for those who cannot have easy access to financial service or goods. But the financial industry is still highly regulated and people in this filed need to get licenses or permission before they can operate, which prevents FinTech firms from running business in compliance with the current financial law. For regulators, how to protect customers and help innovative businesses start up in a friendly environment becomes a major concern. The study aims to propose a set of regulatory strategies suitable for cases in different situations based on the three-step process stipulated by Eric Biber, Sarah E. Light, J.B. Ruhl, and James Salzman. These strategies can prevent regulators from making wrong decisions under political pressure, thus strangling the financial innovation and reducing the fairness of market competition. When there is no available information for reference, it is difficult for regulators to make practical scheme to encourage new business innovations, protect consumers and optimize su-pervision. It will be helpful that authorized FinTech start-ups enter the regulatory sandbox to track new products or services, and then set up a data base with all the information col-lected to improve the standard set-up process and environment of financial related regulations to reduce the resistance from government officials who are unwilling to change to prevent any trouble and doing wrong stuff, especially our legal system. |
