| Popis: | 106 Ever since the WTO Dispute Settlement Body was convened, the amount of cases the DSB deals with that involved Anti-dumping issues has been the majority of all cases. As the situation of international economy keeps on changing, debates over Protectionism and Market Economy have raised great attention and the balance between these two mechanism needs to be found. During this very time period, the research upon Anti-dumping, such as “zeroing” and “de minimis”, will be important, especially which focus on the nations such as the United States, Canada, and the EU, that have been using Anti-dumping measures for trade negotiation purpose for years. At the meantime, Taiwan has been getting more participation about Anti-dumping matters within WTO DSB system not only as third party but as complainant as well, in order to secure trade interest concerning industries of our nation. The most recent case that needed to be study on is the Canada — Welded Pipe case (WT/DS482), which is also one of the main subject of this article. Furthermore, through the researches upon cases, investigations and domestic Anti-Dumping law system of Taiwan, this article expect to take a view about whether it has the abilities to face challenges given by the rapid-changing international Anti-dumping law, including practical issues, investigations of various nations, and the dispute settlement processes. Therefore, to have a thoroughly understanding and an integration of our nation’s current anti-dumping law, this article tends to explore the domestic trade law of Taiwan and the relations between other nations from the view point of WTO dispute settlement practice |
