Study on the Implementation of Prevent, Deter and Eliminate IUU Fishing of Taiwan

The aim of this study is to use comparative analysis to discuss the international management measures on IUU fishing behavior and its development trend, and to examine the codes and practices of the management of IUU fishing behavior in Taiwan, hoping to complement and provide useful suggestions in order to implement the compliant management of our country's offshore fishery correctly. The results of the study are summarized as follows: 1.The IUU fishing practices refer to offences that violate national laws or maintenance and management measures of regional fisheries management organization, reports of unreported or reported irregularities, or difficulties in monitoring the fishing behavior of illegal fishermen. 2.The main causes of the IUU fishing behavior are economic inducement, the MCS is not implemented completely, the penalty is not strict enough, and the evasion of supervision cost is not high and the lack of uniform codes. 3.The impact of fishing practices of IUU is mainly due to the fact that the catches are not known, and the resources of the fishing ground cannot be properly evaluated, which ultimately affect the resource decline, the fishery does not be sustainable, and the basic countermeasures to reduce the IUU fishing activities are the actual management of fishing vessels and catches. 4.The IPOA-IUU approved by FAO in 2001 has become an international basis for the prevention, suppression and elimination of IUU fishing practices, and its management measures focus on the requirements of State responsibility, flag State responsibility, coastal State responsibility, port State measures and regional fisheries management organizations. The Agreement on Port State Measures adopted subsequently is the only legally binding document that will be an important method of treating IUU fishing practices and is the most effective method currently. The Voluntary Guidelines on Flag State Performance emphasized the need for flag States to implement the relevant duties and responsibilities of MCS in order to eliminate IUU fishing practices. 5.The distant water fisheries on the high seas are Taiwan's most important fisheries, so after the adoption of the IPOA-IUU International Plan of Action on the high seas, our country is actively responding to the improving and strengthening the management of distant waterc fisheries. In 2008 for the prevention and control of illegal fish trading and the establishment of the national doctrine of ship owners to establish " Act to Govern Investment in the Operation of Foreign Flag Fishing Vessels ". In 2013, our government referenced IPOA-IUU documents to develop Taiwan’s "NPOA-IUU"; In 2016, our government proposed NPCI plan; In 2017 we developed the act “Act for Distant Water Fisheries “for controlling IUU fishing Behavior, and with FAO-PSMA we stablished " Regulations on the Management and Approval of Foreign Flag Fishing Vessels Entering into Ports of the Republic of China " (Taiwan PSMA). In February 2017, we also set up " 24-hour Fisheries Monitoring Center " with the Coast Guard to carry out the full monitoring of the operation of Taiwanese fishing vessels for the flag State responsibility."
