A Legal Study on the Management of International Matchmaking Business

The 2007 amendment to the Immigration Act prohibits international matchmaking business to acquire remunerations and disseminate, broadcast or publish advertisement about matchmaking. On the other hand, the government began its policy by transforming the matchmaking business into non-profit juridical persons in the hope that it could reinstate their traditional go-between’s position. However, the nature of international matchmaking business and traditional go-betweens are completely different, and as a result, the former nowadays bears the contradictory roles of profit-seeking company and social welfare promoter. Both the legislation and the policy failed to reach their goals. Worse, in order to bypass the law, those involved in the business invented various kinds of “evasive acts”, which further deteriorated the already disadvantaged positions of the clients. Apparently, a lot of legal issues must be dealt with. This thesis attempts to compare the relevant laws of the United States, South Korea, Japan, and Singapore with that of Taiwan in order to reach a justifiable solution regarding international matchmaking. This thesis is of the opinion that the best way to end the commercialized marriage would be to recognize the market nature of international matchmaking business, and place it under legal control. Concrete solutions include constructing appropriate regulations, establishing the autonomy of the guild, issuing certificates to those which have gained public credibility. It is argued that only through this way, both sides may reach a balance on information transparency and fairness. More, violations of human dignity, fraudulent acts or malignant collapse could be largely reduced.
