With respect to aging demographic structure, Taiwan ranks top in the world in which people aged 65 or above account for 13.33%of the population and aging index stands 100.18%. Among every five persons, lives one senior as the population of the elder is more than that of the young. Averagely 5.6 youths take care of 1 senior resulting in potential national security. Long term Care Service Act is legalized in 2015 and enacted in 2017.It covers service range, staff management, unit management, caretaker benefit and service incentives which is our long term care legal foundation and marks long term care system a milestone as well. Life expectancy is increasing that means we are living longer and entering an age when we may need more custodial and medical care as well as supports. Such demand has turned to be basic human right as well as national and social responsibility. In reviewing our long term care system, it disperse in different units such as social, sanitary, retirement administration institutes while they abide by various regulations and laws. For example, some administrative regulations are authorized by parent law while some ones shall be upgraded to the level of Act. Furthermore, the utilization of governmental budget, health and welfare surcharge on tobacco and other revenues to funding long term care fund seems not fair. As we know, long term care service is labor intensive industry, but current manpower is in shortage and professionals need more education and training. Importantly, people hardly recognize and experience such long term care service. This study aims to analyze related legal issues concerning Long term Care Service Act and medical services. To sum up, it is suggested that graded medical treatment and post-dispatch system followed by seamless long term care service as medical care and long term care shall be closely connected and incorporated. Additionally, since finance, manpower and resource are crucial to long term care, the implementation of Lottery tax may help income increment leading to win-win effect.
