The study of the Governance Model of Article 4 of Act Governing Food Safety and Sanitation: How does Precautionary Principle Respond to Risk?

Popis: | 104 Due to a series of food safety incidents come to light, the concern of food safety issue raise in Taiwan during recent years. In June 2013, the Act Governing Food Safety and Sanitation revision included “Precautionary Principle”, which comes from environment law. The precautionary principle is adopted by Taiwanese law for the first time. Nevertheless, the word “precaution” is mistakenly referred to as “prevention” leading the majority people believe the principle is just the same with prevention concept in traditional law. This thesis begins with the origin of the precautionary principle, discovering the concept of precaution, factors and characteristics of the principle in environmental area. Secondly, I discuss “Risk analysis”. This concept has three elements: risk assessment, risk management, and risk communication. The theories are done through referencing European Union Law on its risk management model as basic idea. Furthermore, The Article 4 of Act Governing Food Safety and Sanitation is deeply influenced by the General Food Law (Regulation (EC) No 178/2002) in European Union (EU) and Food Safety Modernization Act (FSMA) in US. In order to clarify the true meaning of this article, I try to analyze the “Precautionary Principle” in EU and “Risk-based Preventive Controls” in US. Finally, I give advise on current institution. Hope that food incidents won’t happen again. |
