Facing the disaster is one of the serious problems for Taiwan, because from The 1999 Jiji earthquake, Taiwan has many the floods, the landslide, the mudflows and landslides, and so on. As a country under the rule of law, which is a caveat to a state's acceptance of a treaty. Therefore, according to the” Disaster Law”, the government could prevent and protect the disaster. In Taiwan, “Disaster Prevention and Protection Act” is for making a sound disaster prevention and protection system, enhancing its functions, in order to protect the safety of people’s lives, bodies, properties and conserve the homeland. Between to the Taiwan’s Disaster Prevention and Protection Act and Japan’s Basic Act on Disaster Control Measures, both of they have arranged the Article, including” Disaster Prevention”, ” Disaster Emergency Response”, and ” Disaster reconstruction” in the order of time. This paper is focus on the“Disaster reconstruction.” However, for discuss in-depth, there are 6 problems and 6 solutions. First, 6 problems as fallows: a) The Disaster Prevention and Protection Act‘s the disaster, b) The Disaster Prevention and Protection Act is the Fundamental Law or not, c) Disaster Prevention and Protection of the Division of Powers between Central and Local Governments, d) Disaster reconstruction’s beginning ad the end, e) The concrete option of Disaster reconstruction, f) Non-governmental organization’s Disaster reconstruction. then, 6 solutions as fallows: I) The definition of in the Disaster Prevention and Protection Act, II) Disaster Prevention and Protection Act should be the Fundamental Law, III) The Division of Powers between Central and Local Governments should from the bottom to the top, IV) Disaster reconstruction should except ” Disaster Prevention”, and ” Disaster Emergency Response.” V) Build the rule of the private donations, VI) Administrative Contracts as the method of control the behavior of the non-governmental organization’s disaster reconstruction.
