Popis: | 103 Supervision to foreign-invested banks refers to measures of intervention and superintendence from government authorities to operational activities of foreign-invested banks in order to safeguard banking security. Banking industry is the essential economics foundation to every State; on the other hand, it is also an industry involved high risks. Accompanied with the rapid development of globalization and the liberalization of macroeconomics, the investment of global corporations is getting competitive. With this respect, some States desire to raise its global economic competitiveness by loosening restrictions on foreign investment. As the supervision and superintendence measures from government authorities not only impact the operation of banking industry but also cause great influences to the stability and development progress of social economics, the regulatory supervision measures to foreign-invested banks has been taken seriously by States. Recognizing the reformation of economics of Mainland China and recalling its promise to World Trade Organization (WTO) regarding the free access to its finance market for banking industry, attracting foreign investment as economic developing policy becomes the irreplaceable strategy to Mainland China. Attracting foreign-invested banks to enter Mainland China finance market will not only bring a hung amount of capital, but also accompanies with certain level of financial risks. But, to some degree, the level of the financial risk will depend on the effeteness of the supervision measures to banks executed by China authorities. If Mainland China intended to further open up its financial service market by attracting larger number of foreign capital banks, it must obtain a complete legal framework and the capacity to provide the protections and legal remedies for financial supervision and superintendence system. This thesis expects to discover and analysis the potential challenges and providing applicable solution to banking supervision and superintendence legal framework in Mainland China by observing the current regulatory status of supervision and superintendence in both local and foreign-invested banks. At the final stage, this study hopes to discover the improvement to competitiveness of local and foreign-invested banking industries by analyzing the influences to Mainland China after the changes in international banking supervision and superintendence framework of financial system caused by Financial Crisis in 2008. |
