The aim of this thesis is to investigate and discuss the hot-debating issues about three types of teachers. One type is about teachers who are dismissed. Another type is about teachers who are suspended by their schools. The other type is about teachers who are unable to get their contracts renewed. This thesis is organized as follows. First, a clear definition of incompetent teachers are given, followed by different perspectives from scholars and the government. The second part is the chronological introduction to the unemployment regulation in Teachers' Act. Some arguments on the important law-amendments are also provided. The third part is about the controversial points in unemployment regulations and the contracts between teachers and schools. Principles of due process of law which schools should follow when teachers are unemployed are also mentioned in this part. The forth part is the case comparison between Taiwan and Japanese in terms of unemployed teachers who are considered incompetent to teach and who do not fulfill their duties to a certain extend. The last chapter is a summary of all the chapters in this thesis. Furthermore, main arguments are presented in this chapter.
