Since the structure of Copyright Acts become more complete and the Copyright awareness continues to rise, the Public Broadcast legal issues related to people’s regular life like hotels, schools, hospitals, supermarkets, hopping malls, and others in public places continue to increase. To rebroadcast the original broadcast content in public happens frequently and is not a new Copyright Act issue. Among all the issues, the most common two issues are (1) simply broadcasting the content of the program by turning on the radio/television in public, or (2) via a different broadcasting system of wire, wireless, or other equipment from the original broadcaster, broadcasting the original sounds or images of the program. In addition to the original broadcast content of the program, the information used to produce the show is also protected by Copyright Act. This creates different types of rights and rights owners. Therefore, the operators of those public places might be claimed for charges by different rights owners at loose end. Moreover, the operators might be threatened with the possibility of bearing criminal liability if they could not reach a common consensus with rights owners. A more complete system to response to this kind of pubic broadcast phenomenon could reduce the burden of the operators and help gain proper profits for the right owners. This system could also reduce the complicated interaction among public broadcast rights, public performance rights, and public presentation rights, and further diminish the negative impact in the society. This study is based on the views of Comparative Law to compare the International Covenants with the laws of other countries. By investigating all the legal regulations of Public Broadcast, it is hoped to learn how to improve our Copyright Acts in order to build up a better system.
