Before the promulgation and implementation of our country’s Science and Technology Fundamental Act, the ownership of all Government-funded R & D results belongs to Country, according to the National Property Act. And, its follow-up management, utility and disposal are subjected to the National Property Act. Moreover, because the legal system policy has not planned the coordinated sets of measures, a large number of Government-funded R & D results can not be transferred to industries, resulting in a waste of national resources. In 1999, after the promulgation and implementation of our country’s Science and Technology Fundamental Act, releasing the Government-funded R & D results to the executive organization to manage and utilitize them makes the output and utilization of the R & D results promoted year by year. But we face the industrial environment continuously changing, the layout of the industrial globalization and the industrial value-chains of multinational distribution have already become a trend. Whether the Government-funded R & D Results Utilization Legal Schemes can respond to industrial environmental changes and company needs, it really needs a review. This study hopes to propose a amendments to the Government-funded R & D Results Utilization Legal Schemes by our government and the United States, through legislative process of the related legal system, analyzing the content of the related regulations, and finding the problems occurred from the promoting mechanism and utilization process of the case study organizations. The study indicates (1) It has a significant effect of valuable creation and industrialization that executive organization set up dedicated units and organizations to promote the R & D results. (2) That our government puts severe stipulations on the R & D results implemented in overseas licensing affects its value and utilization achievements. (3) It becomes a trend for all countries that the legalization of using R & D results turns open and turns to encourage active utilization. Suggest that under the premise of paying attention to industrial competitiveness, protecting the core technologies and national whole benefits, our government can amend the related laws, aiming at the utilization of the R & D results, to make the most effective use of R & D results, and to help our industries advance globally for enhancing international competitiveness.
