The Study of RFID Applications on Police Enforcement

Popis: | 98 RFID technology is extremely popular in hi-tech industry. Many countries and manufacturers vigorously vested research and development in RFID technology globally. In addition to hold relevant seminars, Ministry of Economics promotes RFID’s use in public area. Electronic Fetters, known to the general public, is one example of RFID application. Even though electronic fetters have its flaws, we should not stop the technology development. If we can integrate RFID and GPS technology into electronic fetters, its application in technology monitoring system will be wider as more advancement in its development. The legal system should be in harmony with social development. Regulation may not be more advanced than technology, but regulations should be compatible with current technology development. I began to research in RFID technology area for this area is still unfamiliar to our legal system. In addition, my current service in the police department exposes me to the knowledge that police department has adopted RFID technology, and other departments are evaluating RFID’s usage as well. RFID technology will be widely used in police departments in near future. However, RFID may cause danger of privacy invasion by the police department. It’s important to prevent our world becomes “the Truman’s Show”, where people are under monitoring by the government in every aspect. The first part of this thesis focuses on research motivation, goals, and methods, and most importantly, the question presented and anticipated contribution. In order to have deeper knowledge in its benefits to the police department, the second part focuses on RFID technology system, its distinguishing characteristics, usage frequency, obstacles, history, and current development in Taiwan. The third part discusses RFID’s application in police power exercise. The police department should follow the same principle and limitation application to the police department in its use of RIFD. This chapter also explains when RFID is compatible with police department’s functions. The fourth chapter focuses on disputes in invasion of privacy caused by RFID technology. The chapter introduces history and development of privacy rights as well as US case law, focusing on whether police officer’s use of RFID as a monitoring device in investigation was in violation of the Fourth Amendment. Chapter Five focuses on whether the Law of Communication Protection and Interception is applicable if the police department adopt RIFD as a monitoring device, or Article 11 of the Police Authority Performing Act should be applied. Whether exclusionary rule is applicable when the police department illegally used RFID in investigation. Chapter Six concludes the discussion, and makes suggestions for current legal regime in order to improve personal data protection network. |
