Popis: | 97 The freedom of press and the right to privacy are both constitutional rights. Today, news media has reached every corner of society, and, much worse, even invaded personal privacy. It will seriously destroy human dignity if we absolutely protect the freedom of press. On the contrary, it will restrain freedom of press if we overprotect one’s privacy. In order to avoid news media from abusing freedom of press, we should explicitly define the limit of freedom of press and the right to privacy. In this article mainly focused on the public figures' right of privacy, we firstly take the opinion of the United States federal courts and the one of the European Court of Human Rights as comparison. Subsequently, we will discuss this issue in the viewpoint of law and economics analysis. In the end, we will try to define the limit of freedom of press and the public figures' right of privacy. |
