Popis: | 97 Rules of origin can be divided into non-preferential rules of origin and preferential rules of origin by it’s purposes and policy. Today, the multinational harmonization is focusing on non-preferential rules of origin. Although the Kyoto convention doesn’t distinguish the both, the provisions concern the rules of origin can be reserved and the real enforcement can be limited. However, stipulating preferential rules of origin is the competence of each country, the harmonization on preferential rules of origin is proceeding in the regional groups. The harmonization on non-preferential rules of origin is based on hs nomenclature, but it is important to incorporate the concept of substantial transformation in rules of origin regimes into hs system which highlight the essential character of the goods. Therefore, in determining the origin of the goods that always uses other criteria (such as value added and specific process) to fit in with the substantial transformation of rules of origin in different countries. Despite in non-preferential rules of origin or preferential rules of origin regime, it is common that the harmonization involves the criteria determining the origin of the goods. Thus, there is no policy problem that destroys the multinational harmonization on preferential rules of origin. |
