In this thesis, we study the role played by the home owner's association (HOA) of condominium in the Act of Condominiums. First, the qualification, term, duty and reward for the Committee position are reviewed in the chapter 2. In the chapter 3, we refer to similar laws in other countries such as Japan, German, China, Hong Kong and the United States. Then we discuss the pros and cons of entitling the HOA a commonalty from both theoretical and practical viewpoints in the chapter 4. The establishment and operation of the HOA, and the protection of welfare for the minority of unit owners are reviewed and discussed in the chapter 5. Finally in the chapter 6. The legal dutIies and rights of the Committee directors and the Committee members, and the competition and compromise between this law and another law, in particular the safeguard clause, are discussed in the context of the latest version of this law. The background and summary are included in the chapter 1 and chapter 7 for completeness.
