A Study of the Labor Safety and Health Act as it applies to the Electric Distribution Industry in Taiwan

Popis: | 94 The Electric Distribution Industry is a very specialized area of the market. Lately, in order to cut costs, the Industry has started the policy of outsourcing. They currently outsource all the electric distribution engineering projects to their contractors, and because the jobs are dangerous, their contractors have suffered serious occupational disasters and high casualties. This study first looks at problems of the Labor Safety and Health Act as it applies to the Electric Distribution Industry, focusing on occupational hazards and the responsibilities of both the industry and the contractors. We have discovered the following three controversies: The minimum allowable proximity of a worker’s body to an electrical circuit was shortened without a legitimate reason. The job functions and details of contracts between the industry and the contractors are not clearly defined. There are conflicts between the Electric Distribution Industry regulations and the national laws. After reviewing four practical case studies, we propose four amendments to the Labor Safety and Health Act: 1. Contract work in Labor Safety and Health Act should amend to improve the safety standards in one independent character. 2. Enact more aggressive penalties and state them more specifically. 3. Make both national and industry regulations compatible. 4. Adopt the industry’s lawmaking principles. |
