The Study on the Legal Status and the Marine Resources Exploitation of Pratas Islands

Around by water, Taiwan abounds with various maritime resources, and the people lived on this island knew how to use those marine gifts and were interdependent with them. Not only is the biggest land in South China Sea, but also Pratas Island, located in the southwest sea of Taiwan and 240 nautical miles from Kaohsiung, is the front gate for our strategic entrance. The maritime biological environment around Pratas islands is characteristic of biodiversity and full of non-biology resources. The historic marine valuables left on the seabed of this area are deserved of exploitation Though we are so called as “Ocean Country,” the government, from the past, has been keeping the thought of mainland state to plan the progress of national system. Since central government withdrew from Mainland China and implemented marshal law in Taiwan, people had been kept from beaches, maritime education had been neglected, the policies concerning the ocean had been vaguely integrated planning, and fortifications erection were always the first consideration as well. In the mean time, this circumstance, illegal fisheries from neighbor states, and the influence of El Nino of mother- nature destructed the development of Pratas Islands in recent years. As many precious creatures are damaged severely, they need to be protected and restored. In U.N. Convention on the Law of the Sea, there are regulations concerning the conservation and management of maritime biology resources, and the maritime environment protection. The successful strategies of hot spot biodiversity protection have been adopted in maritime biology conservation. Therefore not only have the biodiversity protection and the resource sustainable yield been becoming the general concept of the whole people in the world, but also the concept of maritime protection zone has been regarded as the important way to maintain the biodiversity and rescue the extinction breeds. In February 2000, Coast Guard Administration, Executive Yuan, took over the management of Pratas Island, taking steps to demilitarize and plan the constructions, improving the facilities of the base and strengthening the maritime patrol, accusing illegal fishery to protect the high quality ecosystem around it, and declared the competence and resolution to maintain the sovereignty in South China Sea. As the integrity development of Pratas Island needs continuously long-term plan and conduction, the government set “Pratas Island National Park” in April 2004, and was eagerly preparing the initial works. This essay, considering domestic and international law cases, tries to research the history of Pratas Island and plan direction at now time for proposals of short, middle, and long term planning aud development, and hopes that the rich maritime resource around this island will be sustainable.
