The institution of administrative corporation is an important legal innovation in the Program for Organizational Reform undertook by the Council of Organizational Reform, Executive Yuan. According to the Executive Yuan’s program, cultural and educational organizations as the National Chung Cheng Cultural Center and national universities have a high priority to becoming administrative corporations. However our country administrative corporation system mainly is from the Japanese independent administrative corporation introduced, and the Japanese independent administrative corporation according to the British executive agency system again since then of. This article understands the background that England, Japan and Taiwan three countries develop these systems from the history of the administrative corporation system with the current conditions that develop currently. Furthermore, public universities becoming public corporations were a principal claim of Taiwan University Law reform movement during 1980’. The spirit of the claim is to request governmental deregulation in university affairs, let university has a chance to build its autonomy. So the current Program for Organizational Reform, especially the national university becoming administrative corporation, correspondent with the trend of higher education reform, should be supported by all national universities. On the contrary, many national universities have the opposite view on the second charter of the draft University Law by the Executive Yuan “administrative corporation national university”. This article inquires into the feasibility and possibility that the administrative corporation in the national university turns output various problems, and carries on commenting on and provide the suggestion.
