At the beginning of 2000’s, the economic development has met a succession of severe transformations in Taiwan. Issues like high labor-intensive industries had kept moving out and improper liquidation of employer have deteriorated the domestic economy structure. Apparently the Labor law and related administrative regulations have protected the labor rights no more effectively regarding constant massive layoffs and business closings! Hence how to protect labor rights form malicious infringement has become one of the most important topics of labor law legislation. The Protective Act for Mass Redundancy of Employees was established through three-reading process in Legislative Yuan on Jan 13th, 2003. This thesis is set to be attempt to analyze related concepts and principles in the Protective Act for Mass Redundancy of Employees. There are quite a few legal issues discussed inside, which includes exploring the meaning of Mass Redundancy, layoff project report and notice obligation, negotiation process between labor and capital, prior notice of redundancy, creditor’s right for labors, protection of re-employment priority. Besides, in order to distinguish differences from similar Acts between Taiwan, R.O.C. and the U.S. through the comparison view of points, the introduction of Workers Adjustment and Retraining Notification Act was cited accrued to help the integrity of legal system in Taiwan .
