Popis: | 90 Epitome This research is divided into five chapters. The first chapter briefly describes Marine Science Research including meaning of marine science research, its necessity, history and factors that will affect marine science research. The second chapter analyzes marine science research activities in various ocean spaces (internal water, territorial sea, contiguous zone, exclusive fishery zone, continental shelf and high sea) under the standard of United Nations Geneva Convention in 1958 and deficiencies of related provisions. The third chapter introduces actual practices in marine science research by countries in the early stage and related regional declarations (for example: Lima Declaration by Latin America countries, Declaration of San Domingo and Declaration Aspects On The Law Of The Sea by African Organization of Unity and the issue of marine science research in United Nations Sea-bed Committee and discussions in the Third United Nations Conference on the Law of the Sea. Chapter 4 explores the standard of marine science research under the 1982 United Nations Convention On The Law Of The Sea especially related provisions of marine science research on continental shelf and exclusive economic zone under the system of the convention. Amongst these, the most important aspects include consent by countries along the sea on the request to conduct marine science research, compulsory consent regime, application of marine science research, obligation that should be observed during the course of marine science research and temporary suspension and suspension of marine science research. In addition, there are descriptions on facilities or equipment of marine science research, international cooperation in marine science research, responsibility and indemnity obligation and solution of disputes in marine science research. Chapter 5 summarizes actual practices on marine science research by various countries at the present and through related legislation it can provide a basis to our country to formulate standards in marine science research law. |
