Data protection certainly isn't the main concern of penitentiary inmates or administrations. But the issue of privacy in correctional institutions is especially well-suited to ask about the requirements for „good legislation“. This work makes suggestions how informational self-determination can be effective in prison thanks to appropriate statutory law. One of the main factors is the limited effectiveness of legal redress in prisons: How can the administration be “programmed” in such a way as to let the basic right to privacy come to fruition, if possible automatically? The correctional institution usually still confronts the inmates as a total institution. It can define and register their lives almost entirely. Therefore life behind bars is of particular interest in order to analyse the importance of data handling for individual freedom and social interactions. Based thereon the author develops practical guidance for legislation in the field of privacy that can easily be adopted for other fields of law. |
