| Popis: | The paper analyzes the evolution of the principle of freedom of contract in the Brazilian Contract Law. Freedom of contract is not absolute, but only prima facie in coordination with the other principles, especially the social function of the contract and the good faith. We also consider the composition of the elements that compound the modern paradigm for the Brazilian Contract Law. |
