Popis: | The new Civil Procedure Code (Law 13.105 / 2015) has brought new perspectives to the debate about the impact of common legislation on the labor process. In this context, the article intends to reflect on the influences and applications of the NCPC, aiming to understand to what extent represent advances or setbacks to the reasonable length of the labor process, considering the constitutionalisation of the process and the constitutional commands that guarantee the reasonable duration of the procedural development. Therefore, the research, which is developed using the deductive method, relies on documentary and bibliographic techniques, using the following descriptors to search for scientific articles: new CPC, work process, procedural duration and constitutionalisation of the process. It is concluded, after the research, that parsimony is necessary in the application of the standard procedural law common to the labor process, given the specificities and teleology of this, as well as, mainly, in view of the norm of the Federal Constitution of 1988 that assures the reasonable duration of the process and the speed of its procedure. |
