Administrative procedure and silence of the Administration. The Argentine and Spanish systems

Popis: The silence of the Administration is an institute in which, by virtue of a legal fiction, is attributed to the lack of response of the public entity a meaningful of disregarding the petition of the citizen. The Spanish and Argentine administrative systems start from two opposing principles: the first assigns to silence — as a rule — a positive character, with exceptions, broad indeed; the second depart of the opposite principle, that the silence produces effects denying, unless express rule. This paper compares both systems and exposes their differences and similarities, highlighting the advantages and disadvantages that each one has.
