The European Court of Human Rights is a chance to be heard, especially for the people who consider themselves wronged in their rights by a national court. Addressing to the Court is usually done by filing an appeal against a national final decision. However, it is admitted to appeal to the Court in other cases, for example when national legislation does not offer the possibility of an effective remedy. In this study, the author identifies and analyzes the terms of form, content and procedure, as well as the mandatory referral preconditions needed to be followed to ensure admissibility in court. |
