Currently it is easily gaugeable that the fundamental rights and guarantees provided in the Constitution of the Federative Republic of Brazil, promulgated in 1988, are not being respected by the Government, so that the Brazilian penitentiary system is relegating all sorts of illness their inmates; once organized to protect the community against those who pose a danger to her, this, does not propose as an immediate purpose, not even a minimum of well- being to its inmates. In this context, we have a term of imprisonment is the most cruel of all current penalties today and it brings to the population, in a way, a peace in knowing that a "criminal" is no longer on the streets. However, it must remember that one of the goals is worth the rehabilitation, and the way the "criminal" has been treated when imprisoned, this does not reach this goal. Instead, acting in diametrically opposite direction, causes the detainee has to be molded to environmental ills in passing to live, bringing harm to society with his arrest, even outweigh the benefits, as subsequently return to social life dehumanized in their dignity. Thus, this article - through literature and deductive-inductive method, aims to examine how the current prison system shows signs that may show evidence of effectiveness of a new totalitarian state. |
