Popis: | The Basketball Arbitral Tribunal represents international arbitrage in field of basketball, which main task is solving disputable situations that arise in basketball. It has greatly contributed to regulating relations in professional basketball and it vastly helped in respecting signed contracts. As an independent body from FIBA, while still in cooperation, BAT enabled all interested parties to resolve disputes quickly, efficiently and cheaply. The procedure before the Tribunal is regulated by the BAT rules of arbitration, while proceedings is characterized by single arbitrator appointed by the BAT president, that the BAT arbitrators decide ex aequo et bono, and other rules aimed at shortening and simplifying the procedure. The Tribunal's decision has res judicata effect and Tribunal has gradually built respectful jurisprudence so far. Although it is a recent date, Tribunal already has significant arbitration practice in its work so far. For all these reasons, this paper will analyze BAT arbitration rules and point out the most important points of this tribunal in resolving basketball disputes. |
