The present study is intended for the theoretical and practical approach to entrapment by state agents. In this respect are highlighted the national legal provisions on the entrapment and the practice of the European Court of Human Rights stating the conditions in which the presence of the committed acts is or not the result of provocative behavior on the part of the state. Also, is trying making delimitation between entrapment and the undercover activity performed under the law. |
