Popis: | The aim of thisstudy is to determine the legal and administrative problems, and the solutionproposals related “Forest Engineering, Forest Industry Engineering andWoodworking Industrial Engineering about the Law” law no 5531. Almost all of theforests in Turkey are under the state ownership (99.9%). According to the provision “State forestsshall be managed and exploited by the State in accordance with the law” in theArticle 169 of the 1982 Constitution, the management and governance of forestsbelong to the State. For this reason, the forestry sector has become a publicsector since almost all activities related to forestry in Turkey are carriedout by the state forestry organization. Law No. 5531 (alsocalled as authorization law) is a legal arrangement that enables forestengineers to carry out professional activities outside the public institutionand constitutes the necessary legal basis for these activities. Forestryoffices which started to be established based on the law no 5531 has played animportant role in carrying out a large number of activities related toforestry.Law No. 5531entered into force in 2006 is a fairly new law. Therefore, it is known thatthere are some problems in practice, and provisions that are need to beamendment. For this purpose, an original questionnaire was prepared for themembers of the TMMOB Chamber of Forest Engineers, and were asked to complete the questionnairesthrough telephone, e-mail, etc. Finally, a total of 63 people were surveyed andthe results were interpreted with frequency values and percentages.While analyzingthe answers to the questionnaires, frequency values and percentages wereinterpreted for the purpose of the research. According to the data obtained;free forestry offices show a profile as are mostly men, aged between 25-35years, graduated with the undergraduate degree, operating for nearly 10 years,graduated between 2006 and 2016, established in the locations of the RegionalDirectorates of Forestry in the province of Istanbul, graduated from theFaculty of Forestry of Istanbul University, with a monthly average income of TL5.000-10.000. On the other hand,the problems that forestry bureau owners mostly faced and listed arebureaucracy density which prevents the works to be carried out more quickly andpractically; the lack of education in the faculties related to the fields ofactivity of the free forestry offices, the lack of practical support in theoryand the inadequate implementation; the excessive price breakdown of theforestry offices and the necessity of the completion certificate etc.Suggestions forsolutions; merit should be given more importance in appointments, reducing theintensity of bureaucracy; uniform files should be requested; communicationneeds to be more warmer and more intimate, and private forestry practicesshould be used more intensively in the sector. The solution to problemsencountered for the legislation and the Chamber of Engineers are; there is aneed to be strictly inspected files without complaint; unfair competitionshould not be tolerated; make the processes objective away from politicizationand to pay attention to the minimum unit prices of the Chamber of Engineers.In order to solvethese problems, it was found that there is a need to meet in asolution-oriented common ground that will be developed by the representativesof TMMOB Chamber of Forest Engineers, faculties of related universities, stateforest organization and related non-governmental organizations. Buaraştırmayla, 5531 sayılı “Orman Mühendisliği, Orman Endüstri Mühendisliği veAğaç İşleri Endüstri Mühendisliği Hakkında Kanun’a” dayanarak kurulan serbestormancılık bürolarında yaşanan hukuksal ve idari sorunlar ve bunlara ilişkinçözüm önerilerinin tespit edilmesi amaçlanmıştır. 5531 sayılı Kanun 2006yılında yürürlüğe girmiş olup oldukça yeni bir uygulamadır. Bu nedenle uygulamadabazı aksaklıklar ve yeniden düzenlenmesi gereken hükümlerin bulunduğubilinmektedir. Bu amaçla TMMOB Orman Mühendisleri Odasına kayıtlı meslekmensupları için özgün bir anket hazırlanarak, telefon, e-posta vb. yoluylaulaşılarak anketleri doldurmaları istenilmiştir. Anket soruları analizinde,frekans değerleri ve yüzde oranları araştırma amacına yönelik yorumlanmıştır. Yapılanaraştırmaya göre serbest ormancılık bürolarına bakıldığında, çoğunlukla erkek,25-35 yaş aralığında, lisans mezunu, 10 yıla yakın faaliyet gösteren, 2006-2016yılları arasında mezun, kuruluş iliolarak Orman Bölge Müdürlüklerinin bulunduğu yerlerde kurulmuş, İstanbulÜniversitesi Orman Fakültesinden mezun, 5.000-10.000 TL arasında aylık ortalamageliri olan bir profil öne çıkmaktadır. Diğer yandan ormancılık bürosahiplerinin büyük oranda üzerinde durduğu sorunlar; işlerin daha hızlı vepratik olarak yürütülmesine engel olan bürokrasi yoğunluğu, serbest ormancılıkbürolarının faaliyet alanları ile ilgili fakültelerde verilen eğitiminyetersizliği, teorikte verilen eğitimin pratik ile desteklenmeyişi veuygulamanın yetersiz oluşu, ormancılık bürolarının aşırı fiyat kırımı ve işbitirme belgesinin gerekliliği vb. şeklinde sıralanmaktadır. Bu sorunların çözümnoktasında ise TMMOB Orman Mühendisleri Odası, ilgili üniversitelerinfakülteleri, devlet orman teşkilatı ve ilgili sivil toplum kuruluşları ileilgili farklı kesim temsilcilerinin geliştireceği çözüm odaklı ortak birpaydada buluşmaya ihtiyaç olduğu tespit edilmiştir. |
