The right of establishment of companies in the EU internal market is provided by the Treaty establishing the European Community. Case law of the Court of Justice of the European Union is very important for interpretation of this right. Twenty years after the first judgment in this legal area, the Court of the European Union in its case Cartesio shows that diversity of legal systems that exist in the Member States are taken into account. Moreover, this diversity should be seen as one of the main advantages of EU market because it leads to competition and impose a more active role of national legislators. The judgement in Cartesio case has induced further harmonization of the right of establishment of companies. The authors deal with analysis of different options as a possible solution. |
