In previous work we compiled the relevant evidence of development to show that repeated but unsubstantiated statements in the academic literature that patents retarded or blocked development in the early incandescent lamp, aircraft, automobile and radio industries were false. Such false statements have nevertheless often been used to support (flawed) patent policy advocacy and it is important to understand the source of these enduring scholarly errors. Here we assess the role of government sources; reports, court decisions, antitrust enforcement actions and Congressional hearings. We propose that it is in the nature of such sources that they are prosecutorial in nature and that scholars should be better advised to employ objective standards for competent evidence of development block. |
