Ikinci bölümde ziya ve/veya hasar sorumlulugunun sartlari,kapsami, sinirlari üzerinde durulmus ve ayrica yardimci ile çalisanlarin sorumluluguda incelenmistir. Üçüncü bölümde de; tasiyicinin sorumluluktan kurtulma sebepleridegerlendirilmistir. Dördüncü bölüm ise; ziya ve/veya hasar sorumluluguna iliskindava ve talep haklarinin kullanilmasina ayrilmistir. Burada davali ve davacilar, ispat,dava ve talep haklarinin düsmesi ve zamanasimi süreleri üzerinde ayrintili olarakdurulmustur.Çalismamizin sonuç bölümünde ise, konuyla ilgili tespit ve öneriler yeralmaktadir. This thesis, named `The Liability Of Carrier For Loss And Damage InAccordance With The International Conventions For Carriage Of Goods? is examiningconventions, namely the Convention On The Contract For The International Carriage OfGoods By Road (CMR), Uniform Rules Concerning The Contract For InternationalCarriage Of Goods By Rail ? Appendix B To The Convention Concerning InternationalCarriage By Rail (COTIF-CIM), Warshaw Convention For The Unification O f CertainRules Relating To International Carriage By Air Ammended as with The Hague and 4thMontreal Protocol, The Hague Rules (1924 Brussels Convention) and The Hague-VisbyRules (Brussels Protocol in 1968 and 1979), United Nations Convention OnInternational Multimodal Transport Of Goods (MTC-1980) in accordance with thearticles on liability of carrier dealing with loss and/or damage s.In the first chapter of study, the applicability issues of each conventions havebeen taken into account separately. In second chapter; definitions of loss and damage,conditions, limits, and periods of liability of carrier has been dealt with. Specially,servants and agents? liability and carrier?s liability dealing with their practice has beenworked out. In this chapter each conventions dealt with together. Third chapter is relatedto the exceptions to the liability of carrier. All exceptions and their specifiacatins havebeen searched separately and differences among the conventions have researched. Atfourth cahpter, the claims and litigation issues have been dealt with. In this respect;claimants, defendants, evidence, the loss of right to apply and time limits have beenstudied separately. Differences and similarities of the conventions on the issue have beendetermined and studied.At the end of thesis, our findings, comments and suggestions have beensupplied dealing with every means of carriage. 442 |
