Bu tez çalışmasında, boşanmanın çocuk açısından hukuki sonuçları tetkik edilmiştir. Bu doğrultuda tezin birinci bölümünde, ulusal ve uluslararası kaynaklardan derlenen araştırmalar kapsamında çocuk ve çocukluk kavramlarına yer verilmiş olup çocuk haklarına ilişkin temel ilkelerden bahsedilmiştir. İkinci bölümünde, boşanmanın velayet açısından sonuçlarına değinilmiş olup velayet kavramı, velayet hakkının hukuki niteliği ve temel özellikleri, velayet altında olan kişiler ve velayet hakkına sahip kişiler, velayetin tevdi edilmesinde hâkimin takdir yetkisi, velayet hakkının kapsamı ve kullanılması, çocuğun kişi varlığının ana babasına karşı korunması, velayet hakkının yeniden düzenlenmesi, velayet hakkının sona ermesi ve velayete yönelik davalarda görevli ve yetkili mahkemelere ilişkin konulara ayrıntıları ile yer verilmiştir. Üçüncü bölümünde, iştirak nafakası tanımı ve kapsamı, süresi, tarafların dava hakkı, nafaka miktarının belirlenmesi ve ödenme biçimi, nafaka yükümlüsü ya da alacaklısının durumunun değişmesi, çocuğun hakkı olan nafakanın ödenmesi için geçici alınan önlemler ve güvence verilmesi, iştirak nafakasının tabi olduğu zamanaşımı ve iştirak nafakasına ilişkin davalarda görevli ve yetkili mahkemelere yönelik konular teferruatıyla anlatılmıştır. Dördüncü bölümünde ise, boşanma sonrası çocuk ile kişisel ilişki kurma hakkından bahsedilmiş olup kişisel ilişkinin tanımı ve hukuki niteliği, kişisel ilişki kurma hakkına sahip olan kişiler, kişisel ilişkinin içeriğinin düzenlenmesi, kişisel ilişki kurma hakkının sınırları, kişisel ilişkinin cebri icra yoluyla kurulması, kişisel ilişki kurulmasıyla ilgili davalarda görevli ve yetkili mahkemelere ilişkin yetki ve görev konuları doktrindeki tartışmalar ve Yargıtay kararları ile birlikte ele alınmıştır. Sonuç bölümünde ise boşanmanın çocuk açısından hukuki sonuçları konusunda ulaşılan sonuçlar özetlenerek çözüm önerileriyle birlikte paylaşılmıştır. In this thesis, legal consequences of divorce for child are examined. In this respect, in the first part of the thesis, the concepts of child and childhood are covered within the scope of national and international sources and basic principles about child rights are mentioned. In the second part of the thesis, the results of divorce in terms of custody, the concept of custody, the legal nature and basic characteristics of the custody right, the persons under custody and the persons having the custody, the discretion of the judge in entrusting of custody, the scope and use of the custody right, the protection of the child's existence against the parents, rearrangement of the custody right, the end of the custody right, and the matters about the governing and competent courts for custody cases have been given in detail. In the third section, the definition, scope and duration of child support, the right of the parties to the lawsuit, the determination and payment of the child support amount, the change of the status of the child support obligor or its creditor, provision of temporary measures and assurance for the payment of the child's rights, the statute of limitations for child support and the matters about governing and competent courts related to child support cases are explained in detail. In the fourth chapter, the right to establish a personal relationship with a child after the divorce is mentioned and the definition and legal nature of the personal relationship, the persons who have the right to establish a personal relationship, the regulation of the content of the personal relationship, the limits of the right to establish a personal relationship, the establishment of a personal relationship through foreclosure, the duty and authorization of the governing and competent courts about the cases of forming personal relationship about those subjects are examined with debates of doctrine and supreme court judgements. In the conclusion section, the results of legal consequences of divorce in terms of the child are summarized and shared with the solution proposals. 242 |
