Popis: | Tema mog diplomskog rada su kolektivni ugovori. Kroz svoj rad pokušala sam objasniti što su to kolektivni ugovori, koja je njihova svrha, tko su stranke kolektivnih ugovora te način sklapanja i prestanka kolektivnih ugovora. Kolektivni ugovori predstavljaju sporazum zaključen između predstavnika radnika i poslodavaca usmjeren rješenju pitanja iz radnog odnosa ili u vezi s radnim odnosom, od interesa za radnike i poslodavce. Sklapanje kolektivnih ugovora je proces u kojem subjekti imaju određena ovlaštenja te je to postupak prema unaprijed određenim pravilima. Postoje tri vrste postupka koji mogu dovesti do sklapanja kolektivnog ugovora a to su : pregovaranje, mirenje i arbitraža. U Republici Hrvatskoj najzastupljeniji način su kolektivni pregovori. Stranke koje sudjeluju u kolektivnim pregovorima su na strani radnika – sindikati koji moraju ispuniti uvjet reprezentativnosti i poslodavci. Na strani poslodavaca se kao stranke može pojaviti i Republika Hrvatska. Zakon o radu razlikuje proširenu i produženu primjenu kolektivnih ugovora. Proširenom primjenom kolektivni ugovor se proširuje na stranke koje nisu sudjelovale u sklapanju kolektivnog ugovora, ukoliko za to postoji javni interes. Produženom primjenom kolektivni ugovor se primjenjuje i nakon roka na koji se sklopljen. Kolektivni ugovori mogu prestati na dva načina a to je protek vremena na koje j e kolektivni ugovor sklopljen i otkaz kolektivnog ugovora. U slučaju povrede prava iz kolektivnog ugovora stranke imaju mogućnost sudske zaštite i štrajka. The subject of my graduation thesis is collective agreements. Through my work, I tried to explain what collective agreements are, what their purpose is, who are the parties to collective agreements, and how to conclude and terminate collective agreements. Collective agreements represent an agreement concluded between representatives of workers and employers aimed at solving issues from the employment relationship or related to the employment relationship, of interest to workers and employers. The conclusion of collective agreements is a process in which entities have certain powers, and it is a procedure according to predetermined rules. There are three types of procedures that can lead to the conclusion of a collective agreement, namely: negotiation, conciliation and arbitration. In the Republic of Croatia, collective negotiation is the most common method. The parties participating in collective negotiations are on the side of the workers - trade unions that must meet the condition of representativeness and employers. On the employers' side, the Republic of Croatia can also appear as a party. The Labor Law distinguishes between extended and extended application of collective agreements. With extended application, the collective agreement is extended to parties that did not participate in the conclusion of the collective agreement, if there is a public interest in doing so. With extended application, the collective agreement is applied even after the term for which it was concluded. Collective agreements can end in two ways, namely the passage of time for which the collective agreement was concluded and cancellation of the collective agreement. In case of violation of rights from the collective agreement, the parties have the possibility of court protection and strike. |
