Popis: Article 25 of the Italian Statute on Private International Law states that companies are governed by the law of the country where the company was incorporated and that, however, Italian law shall apply if the administrative seat or the main object of the company is located in Italy. Is the latter part of this rule compatible with EU principles on freedom of establishment? This was recently asked by the Italian Supreme Court (Corte di Cassazione), which brought the matter before the Court of Justice of the European Union. The article attempts to answer the question.
