Popis: | Diplomski rad za cilj ima prikazati djelovanje Vojnog suda oblasti 8. korpusa Narodnooslobodilačke vojske Jugoslavije. U početnom je dijelu rada kratko prikazan postupni razvoj partizanskog pokreta, njegove vojske i osnovnih institucija vlasti. U idućem je poglavlju dan osvrt na povijest 8. korpusa, s naglaskom na ratni put i vojne operacije u kojima je korpus sudjelovao. Slijedi kronološki prikaz razvoja partizanskog vojnog sudstva u ratnom periodu gdje je bilo nužno spomenuti temeljne propise i uredbe koji su vodili do postupne organizacije sudstva. Osim toga, iznijete su i osnovne značajke djelovanja vojnih sudova, od čega je najbitnije istaknuti obaveznu suradnju s OZN-om koja je gušila neovisnost sudova. Temeljni dio rada bavi se Vojnim sudom oblasti 8. korpusa. Analizirano je 37 presuda koje su donijela različita sudska vijeća ovoga suda: Vijeće pri Komandi cetinskog područja, Vijeće pri Komandi srednje dalmatinskog otočkog područja i Vijeće pri Komandi područja srednje Dalmacije. Budući da među njima nije bilo smrtnih presuda, a kako se ne bi stekao pogrešan dojam o navedenom sudu, prikazana je i nekolicina smrtnih presuda o kojima je izvještaje pisala Slobodna Dalmacija. U svakom slučaju, sve su ove presude dale dobar uvid u način djelovanja spomenutog suda. Presude su pisane kratko i sažeto, postupak pred sudom bio je brz, vojni sud vodio je postupke i protiv civila, suđenja su često bila javna i masovna, a neodređenost pojedinih članaka Uredbe o vojnim sudovima ostavljala je prostor za različite interpretacije zločina. This diploma paper is aimed at rendering the actions of the People’s Liberation Army of Yugoslavia Eighth Corps District Court Martial. What are rendered shortly in the paper’s initial part are the gradual development of the Partisan movement, its Army and its fundamental governmental institutions. In the next chapter, there is the review of the Eighth Corps’ history, with the emphasis upon its war path and military operations where it contributed. What follows is the chronological review of the development of the Partisan court martial institutions in the wartime where it was necessary to mention the fundamental regulations and decrees which had led to the gradual organisation of those institutions. Besides, what are also rendered are the basic characteristics of the actions of the courts martial where there is most important to emphasise the obligatory cooperation with OZNA which smothered the independence of the courts martial. The paper’s central part deals with the Eighth Corps District Court Martial. There have been 37 verdicts analysed reached by the individual court assemblies of the Court Martial which include Cetina Region Headquarters Assembly, Central Dalmatia Island Region Headquarters Assembly and Central Dalmatia Headquarters Assembly. Since there were no death penalties reached in either of the Assemblies, but also in order to ensure that there has been made no wrong impression of the Court Martial, there have been a few death penalties rendered reported by Slobodna Dalmacija. In any case, all of these verdicts have given the good introspect in the way the Court Martial acted. The verdicts were written in a short and summarised way, the court procedure was fast, the Court Martial also proceeded the civilians, the proceedings were often exposed to the public and to the masses and the vagueness of some articles of The Court Martial Decree was leaving a plenty of space for the different interpretations of the crimes. |
