Popis: Svrha ovog rada je na osnovu vaţećih zakonskih propisa analizirati problematiku pravnih aspekata sigurnosti plovidbe na obalnom moru u RH. U RH uvjeti sigurnosti plovidbe određeni su PZ-om, ali i uredbama Europske unije, podzakonskim propisima i tehničkim pravilima koje donosi ministar pomorstva. Sigurnost plovidbe je skup propisa koji normiraju sigurnost brodova u plovidbi na moru i na unutrašnjim plovnim putovima. Također, sigurnost plovidbe je širi pojam pa se sukladno tome u radu obrazlaţu i pomorski objekti koji su namijenjeni za plovidbu morem ili objekti stalno privezani ili usidreni na moru, odnosno objekt u potpunosti ili djelomično ukopan u morsko dno ili poloţen na morsko dno. Lučko područje je područje morskih luka koje obuhvaća jedan ili više morskih i kopnenih prostora (lučki bazen), koje se koristi za obavljanje lučkih djelatnosti, a kojima upravlja lučka uprava, odnosno ovlaštenik koncesije, a granica lučkog područja je granica pomorskog dobra. Kako bi se provodila kontinuirana kontrola sigurnosti, za to sluţi inspekcijski nadzor u području sigurnosti plovidbe, koji obavljaju inspektori sigurnosti plovidbe Ministarstva pomorstva i lučkih kapetanija, ima vaţnu ulogu. Oni sudionici pomorske plovidbe koji se ne pridrţavaju zakonskih i drugih propisa podlijeţu pomorskim i plovidbenim prekršajima. The purpose of this paper is to analyze, on the basis of valid legal regulations, the issue of legal aspects of navigation safety on the coastal sea in the Republic of Croatia. In the Republic of Croatia, the conditions for navigation safety are determined by the Maritime Code, but also by European Union regulations, by-laws and technical rules issued by the Minister of Maritime Affairs. Navigation safety is a set of regulations that regulate the safety of ships in navigation at sea and on inland waterways. Also, the safety of navigation is a broader concept, so the paper also explains maritime objects that are intended for sea navigation or objects that are permanently moored or anchored at sea, that is, an object completely or partially buried in the seabed or laid on the seabed. A port area is an area of sea ports that includes one or more sea and land areas (port basin), which is used for carrying out port activities, and which is managed by the port authority, i.e. the concession holder, and the border of the port area is the border of maritime property. In order to carry out continuous safety control, this is the purpose of inspection in the field of navigation safety, which is carried out by navigation safety inspectors of the Ministry of Maritime Affairs and Port Authority. For those participants in maritime navigation who do not comply with legal and other regulations, they are subject to maritime and navigation violations.
