The monograph, written by Andrej Berden, offers (as it follows from its title) authors legal theoretical views on ownership. His basic assumption is, that today, ownership is not a unitary concept, based upon the exclusive right of an individual to enjoy, use and dispose of the subject of his right. Ownership is differentiated with regard to its subject. Therefore, the ownership of articles for personal use substantially differs from ownership of immovables, especially of immovables of special importance, such as agricultural land and forests. As regards the latter, the substance of ownership is to a great extent determined by limitations, imposed by public law, which are, as the author emphasizes, a substantial part of ownership as such. Monografija Andreja Berdena podaja, tako kot kaže njen naslov, avtorjeve pravnoteoretične poglede na institut lastnine. Temeljna avtorjeva teza je, da lastnina danes ni več enoten koncept, ki bi temeljil na izključni pravici posameznika, da predmet svoje lastninske pravice uživa, uporablja in z njim razpolaga. Lastnina se glede na svoj predmet razlikuje. Tako se lastnina predmetov za osebno rabo bistveno razlikuje od lastnine nepremičnin, še zlasti ko gre za nepremičnine posebnega pomena, kot so kmetijska zemljišča in gozdovi. Pri slednjih je vsebina lastninske pravice večinoma določena z javnopravnimi omejitvami, ki so, kot poudarja avtor, del lastninske pravice same. |
