Przedmiotem artykułu jest przedstawienie konstytucyjnych i międzynarodowych aspektów zasady domniemania niewinności w postępowaniu karnym. The aim of the article is to highlight the most important aspects of the constitutional presumption of innocence, discuss the content of this procedural rule, the presumption of innocence relationship with press law and civil law, and finally determine its place and the consequences of violating its provisions in the Polish criminal trial in the 21st century. The author presents the functions of the principle, discusses the case law of the European Court of Human Rights, the Constitutional Tribunal and the Supreme Court, as well as indicates the procedural consequences of violation of this principle. The author draws attention to the provisions of the new Directive (Eu) 2016/343 of the European Parliament and of The Council of 9 March 2016 on the strengthening of certain aspects of the presumption of innocence and of the right to be present at the trial in criminal proceedings and signals difficulties in respecting the principle of the presumption of innocence in the online society of the 21st century. |
