Tez (Yüksek Lisans) -- İstanbul Ticaret Üniversitesi -- Kaynakça var. KKX 569/K57 Edinilmiş mallara katılma rejimi, kadın ile erkek arasındaki eşitlik noktasında önemli fayda ve kazanımlar sağlamış olsa da uygulamada bazı zorluklar yaşanmaktadır. Bu tezi hazırlamadaki amacımız “Katılma Alacağı” konusunu doktrinde bulunan görüş ayrılıklarını Yargıtay kararları doğrultusunda incelemektir. Tez çalışmam altı bölümden oluşmaktadır. İlk bölümde genel bilgilendirmeler, ikinci bölümde mal türleri, üçüncü bölümde katılma alacağı ve özellikler, dördüncü bölümde katılma alacağının hesaplanması, beşinci bölümde katılma alacağının belirlenmesinde karşılaşılan diğer konular, altıncı bölümde ise görevli ve yetkili mahkemeler ile zamanaşımı konuları hakkında bilgi verilmiştir. Tüm konularda gerek doktrindeki farklı görüşlere gerekse de Yargıtay uygulamasına yer verilmiştir. The objective of presenting this paper is to analyze "Participation Asset" in accordance with the differences of opinion in doctrine and the decisions of the Supreme Court. Especially, different arguments on certain topics bring several problems in practice. Our thesis is made up of six parts. In the first part provides general information, the types of properties in the regime of participating to acquired property in the second part, the participation asset and conditions in the third part , the calculation of the participation asset in the fourth part, the other issues encountered in the determination of the participation asset in the fifth part, and in the sixth apart, the issues related to the competent courts and the statute of limitations.
