ZAKONODAJA IN UPRAVNI POSTOPEK ZA PRIDOBITEV GRADBENEGA DOVOLJENJA ZA NEZAHTEVEN OBJEKT

Popis: Gradbena zakonodaja se je v preteklosti veliko spreminjala in dopolnjevala. Cilj spreminjanja zakonodaje je zmanjšanje administrativnih ovir, ter da bi zakonodaja postala enostavnejša in bolj razumljiva. Nova gradbena zakonodaja, sprejeta leta 2017, je v sistem dela vnesla spremembe in nova pravila na vseh področjih, ki so povezana z graditvijo objektov. Gradbeni zakon je posodobil tudi postopek pridobitve gradbenega dovoljenja za nezahteven objekt. Namen diplomskega dela je ugotoviti razlike, do katerih je prišlo s spremembo gradbene zakonodaje pri postopku pridobitve gradbenega dovoljenja za nezahteven objekt. Ugotoviti želim, ali so bile administrativne ovire v omenjenem postopku zmanjšane, in ali se je postopek poenostavil. Za raziskovanje področja je bila uporabljena normativna in deskriptivna metoda analize primarnih in sekundarnih virov. Uporabljena je bila tudi metoda primerjanja zakonodaje. Bistvene razlike med Zakonom o graditvi objektov in Gradbenim zakonom se pojavijo pri poteku postopka in pri spremenjeni potrebni dokumentaciji za pridobitev gradbenega dovoljenja za nezahtevni objekt. Gradbeni zakon kot novost na področju gradnje nezahtevnih objektov uvaja enoten postopek pridobitve gradbenega dovoljenja, prijavo začetka gradnje nezahtevnega objekta in natančna merila njegove gradnje. Gradbeni zakon je v veljavo stopil leta 2018, zato to področje še ni raziskano. Zaradi nepoznavanja nove gradbene zakonodaje le-ta povzroča veliko nejasnosti med izvrševalci zakonodaje kot tudi med strankami postopka. Vsebina diplomskega dela vsebuje analiziran postopek pridobitve gradbenega dovoljenja za nezahteven objekt po prej veljavnem ZGO-1 in trenutno veljavnem GZ. Navedene razlike, ki jih prinaša GZ, so predstavljene in opisane ter omogočajo boljše razumevanje zakonodaje za pridobitev gradbenega dovoljenja za nezahteven objekt. The Slovenian Construction Act was constantly changing in the past. The main aim is to reduce administrative barriers and make the Construction Act easier in terms of being more understandable. The renewed Act was adopted in 2017 and brought changes and new regulations in all areas that are connected to construction. It also updated the procedure to obtain a building permit for the construction of simple facilities. The aim of this thesis is to detect the modifications to the old Act, especially those concerning the procedure for obtaining a building permit for a simple facility. It should also reveal whether the administrative barriers were actually reduced and the whole procedure was simplified. For research purposes, primary and secondary sources were analyzed with the help of normative and descriptive methods. In addition to this, also a method of comparing the old and the renewed legislation was used in the research. Crucial differences between the Construction Act and the Construction Law emerge in the procedure itself and the newly determined documentation required to obtain a building permit for a simple facility. The Construction Law as a novelty in the field of constructing simple facilities introduces a steady procedure for obtaining a building permit, the announcement of the beginning of building a simple facility and the precise criteria for building a simple facility. The Construction Law entered into force in 2018, therefore it is still an unexplored field. Because the law enforcers and also the clients are unaware of the new Construction Act, it is causing many obscurities. This thesis contains an analyzed procedure for obtaining a building permit for a simplified facility by the old Act ZGO-1 and the current GZ (Construction Law). Listed modifications to the old Act are presented as well as described in this thesis and serve for a better understanding of the Construction Law for obtaining a building permit for a simple facility.
