Popis: Med letoma 1915 in 1922 je bil s strani Otomanskega imperija izvršen genocid nad Armenci, ki je v literaturi mnogokrat opisan kot pozabljen genocid. V tem obdobju so poboje in deportacije Armencev spremljali še odvzem skoraj vsega armenskega premoženja ter uničevanje kulturne dediščine zgodovinske Armenije. Cilj magistrskega diplomskega dela je predstavitev glavnih mednarodnopravnih mehanizmov, ki nudijo možnosti uveljavljanja reparacij za primere, kot je armenski genocid, vključno z analizo možne uporabe Konvencije o preprečevanju in kaznovanju zločina genocida ter sporazuma iz Sèvresa. Pri tem so obravnavane teme odprave posledic škode za smrtne žrtve armenskega genocida, premoženjsko škodo ter izgubljeno ozemlje Armenije, prav tako pa pregled postopkov, ki so bili do sedaj namenjeni zasledovanju dodelitve učinkovitih reparacij zaradi armenskega genocida. Magistrsko diplomsko delo tako obravnava hipotezo, da mednarodno pravo ne nudi učinkovitih mehanizmov reparacij za primere, kot je armenski genocid, kjer so otežujoče okoliščine čas izvršitve genocida in pomanjkljivi pravni instrumenti tistega časa. Between 1915 and 1922 the Ottoman empire committed genocide against its Armenian population, which has often been described in the literature as the forgotten genocide. Murders and deportations of Armenians were accompanied by expropriation of practically all their belongings and by the destruction of the cultural heritage of historic Armenia. The aim of this master's thesis is to present the main legal international reparation mechanisms, available in cases such as the Armenian genocide, including an analysis of possible application of the Convention on the Prevention and Punishment of the Crime of Genocide as well as the Treaty of Sèvres. The thesis addresses consequences of damages from the fatalities during the Armenian genocide, for the property damage and for the loss of Armenian land, but also an overview of procedures that have so far been applied for the purpose of making reparations in the case of the Armenian genocide. The master’s thesis thus deals with the hypothesis that international law does not provide effective reparation mechanisms for cases such as the Armenian genocide, where the aggravating circumstances are the passage of time since the genocide and deficiency of legal instruments of the period.
