| Popis: | La Ley 270 de 1996 dispone que el ingreso de los funcionarios judiciales debe hacerse conforme al Sistema de Carrera Judicial; no obstante, existe un alto porcentaje de jueces de la Jurisdicción Ordinario ejerciendo su cargo sin haber aprobado el Concurso de Méritos. Este documento consiste en una investigación realizada sobre los mecanismos que han sido empleados para la designación de jueces sin la aprobación del concurso de méritos. Igualmente presenta el panorama actual de la Carrera Judicial en cuanto a la Jurisdicción Ordinaria, incluyendo un análisis de las cifras reales de los jueces que ejercen cargo en provisionalidad, en comparación con los datos presentados por el Consejo Superior de la Judicatura. Se explica, desde una perspectiva práctica, la forma en que los jueces ordinarios ingresan a la Rama Judicial, incluyendo las convocatorias y los concursos, cuando se hace por medio del mérito. Law 270 of 1996 establishes that the conformation of Judiciary must be executed in accordance with the Judicial Career System. However, there is a high percentage of judges of the Ordinary Jurisdiction who are in their role without approving the Merit Contest. This document consists of an investigation carried out on the mechanisms that have been used for the appointment of judges without the approval of the Merit Contest. It also presents the current panorama of the Judicial Career in terms of the Ordinary Jurisdiction, including an analysis of the real figures of the judges who hold a provisional position, in comparison with the data presented by the Superior Council of the Judiciary (Consejo Superior de la Judicatura). It explains, from a practical perspective, the way in which ordinary judges are named for their roles, including the legal contests and it process, when it is done through the merit system.
