Popis: RESUMEN:Los í­ndices de adopción en Chile, en relación al número de niños ubicados en sistemas de cuidados alternativos, resulta considerablemente bajo. Si bien existen una multiplicidad de factores que motivan la situación anterior, uno que estimamos de particular releí‚­vancia, se vincula a una errada interpretación del principio de subsií‚­diaridad de la adopción; en función de la cual, se privilegia el derecho de los padres, por sobre el derecho de los niños a vivir y criarse en el el seno de una familia, lo que estimamos contraviene su interés superior. El objetivo del presente artí­culo es analizar el derecho del niño a vivir en familia y el principio de subsidiaridad de la adopción, a la luz del interés superior del niño. ABSTRACT:Adoption rates in Chile, in relation to the number of children placed in alternative care systems, are considerably low. Although there are a multiplicity of factors that motivate the previous situation, one that we consider of particular relevance, is linked to a mistaken interpretation of the principle of subsidiarity of adoption; according to which, the right of the parents is privileged, over the right of the children to live and be raised in the bosom of a family, which we consider to be in contravention of their superior interest. The objective of this article is to analyze the child’s right to live in a family and the principle of subsidiarity of adoption, in the light of the best interests of the child.
