No. of bitstreams: 1 Lucas Fernandes Calixto_04.03.2020.pdf: 1698047 bytes, checksum: a83a772a0ea0f540fdd5fbc5b824e95f (MD5) Previous issue date: 2020-03-04 Sem bolsa O presente trabalho pretende assentar a base teórica e metodológica, bem como através de roteiro prático ao final proposto, sobre as quais se pretende discorrer sobre uma Ação Civil Pública Colaborativa em demandas de saúde, isto é, uma ação em que o legitimado ativo e a Administração Pública demandada permitam, em conjunto e com amparo no artigo 6º do Código de Processo Civil, que a decisão judicial seja tomada pelo Poder Judiciário de forma democrática e com amplo diálogo, pelos sujeitos processuais, sobre a tensão que paira sobre o binômio mínimo existencial/reserva do possível. This dissertation intends to establish the theoretical and methodological bases, as well as through a pratical script, in which it is intended to discuss the viability of a Colaborative Public Civil Action in health demands, that is, an action in which the legitimized and the Administration, together, based in Article 6 of the Code of Civil Procedure, that the judicial decision can be taken by the Judiciary in a democratic mode and with a wide dialogue, by the processuals subjects, on the tension that hangs over the binominal minimum existential / reservation of the possible.
