Popis: В статье приводятся наиболее распространенные в научной литературе точки зрения относительно места договора о международной передаче технологии в системе гражданско-правовых договоров. На основании проведенного анализа делается вывод о целесообразности выделения договоров о международной передаче технологии в отдельный класс договоров.
The article is devoted to the research of the issue regarding the legal basis of the agreement relating to the international transfer of technology. It is provided in the article three main science points of view concerning the place of the agreement relating to the international transfer of technology in the system of civil law agreements as follows: 1) assignment of objects of intellectual property agreements are not the innominate agreements and are related to the different agreements: service agreements, construction agreements, sales and purchase agreements, exchange agreements, gift agreements, lease agreements; 2) assignment of objects of intellectual property agreements are mixed agreements; 3) assignment of objects of intellectual property agreements are innominate agreements ( sui generis ). At the same time despite the fact that agreement relating to the international transfer of technology bears some similarity to the agreements that are provided by the civil legislation (sales and purchase agreements, lease agreements, service agreements, etc.) nevertheless this agreement has features which allow to draw a conclusion that there are reasons to presume that agreement relating to the international transfer of technology is a separate kind of agreements.
