Popis: | Diplomska naloga obravnava odškodninsko odgovornost v delovnem razmerju po pravu Republike Slovenije. Opisane so temeljne značilnosti instituta odškodninske odgovornosti, ki je urejen v Zakonu o delovnih razmerjih, Zakonu o javnih uslužbencih in Obligacijskem zakoniku, ter njihova primerjava. Zakon o delovnih razmerjih je temeljni zakon, ki ureja individualna delovna razmerja, vključno z odškodninsko odgovornostjo. Zakon o javnih uslužbencih je posebno uredil odškodninsko odgovornost za javne uslužbence zaposlene v državnih organih in upravah samoupravnih interesnih skupnosti, vendar velja v celoti le za neposredne proračunske uporabnike, za ostale javne uslužbence pa veljajo določila omenjenega zakona le do 21. člena, v katerih ni določena odškodninska odgovornost. Zakona o delovnih razmerjih se v razmerju do Zakon o javnih uslužbencih uporablja subsidiarno in sicer za tista vprašanja, ki jih slednji ali pa drug poseben zakon za javne uslužbence ne urejata drugače. Primerjava navedenih zakonov pokaže, da je institut odškodninske odgovornosti zelo podobno urejen v obeh zakonih in da ne bi bilo treba posebej določati odškodninske odgovornosti v Zakonu o javnih uslužbencih. Določeni so enaki pogoji odškodninske odgovornosti in pavšalna odškodnina. Določenih razmerij odškodninske odgovornosti, kot so odgovornost večjega števila javnih uslužbencev in omejene odškodninske odgovornosti, Zakon o javnih uslužbencih ne ureja. The thesis is studies the liability for damages in employment relationships defined by the law of Republic of Slovenia. Described are the basic characteristics and their comparison of the institution of liability for damages which is regulated in the Employment Relationships Act, the Civil Servants Act and the Code of obligations. The Employment Relationships Act is a basic act which settles individual employment relationships, including the liability for damages. Civil Servants Act particularly settles liability for damages for civil servants employed within state bodies and the administrations of self-governing local communities however, in whole, it is only applicable for direct budget users. For other civil servants only the provisions of the first 21 Articles of the latter-mentioned act, in which the liability for damages is not settled, are applicable. Employment Relations Act, in comparison to Civil Servants Act, is subsidiarily executed in cases in which the CSA or any other particular law for civil servants are not regulating these cases differently. The comparison of the mentioned statutes shows that the institution of liability for damages is similarly settled in both statutes, and that there is no need to settle the liability for damages separately in the Civil Servants Act. The conditions for liability for damages and lump-sum compensation are equally defined. Civil Servants Act is not regulating certain proportions of liability for damages, for instance, responsibility for higher number of civil servants and limited liability for damages. |
