PRINCIPLES OF THE SMALL CLAIMS PROCEDURE BY CPA AND COMPARISON WITH EUROPIAN SMALL CLAIMS PROCEDURE

Popis: Magistrsko delo je osredotočeno na načela v postopku v sporu majhne vrednosti, ki je na ravni našega nacionalnega prava urejen z Zakonom o pravdnem postopku (v nadaljevanju ZPP) ter na evropski ravni z Uredbo (ES) št. 861/2007. Proti koncu magistrskega dela sledi primerjava obeh postopkov. Navedeni postopek je poseben zaradi nizke vrednosti zahtevka, ki znaša 2.000 evrov in ravno zaradi tega se načela pri tem posebnem postopku razlikujejo od načel rednega postopka. Ne glede na prirejenost načel in poenostavljenost postopka v sporu majhne vrednosti pa ni zmanjšana kakovost pravdnega varstva. Poleg notranjih sporov pa večkrat pride tudi do čezmejnih sporov, kajti vse več ljudi se poslužuje spletnih nakupov, s čimer se veča število čezmejnih sporov. Zaradi lažjega dostopa do sodnega varstva je bila na ravni Evropske unije sprejeta Uredba (ES) št. 861/2007 o uvedbi evropskega postopka v sporih majhne vrednosti, ki poenostavlja in pospešuje čezmejne spore majhne vrednosti. Skozi čas pa se je pokazalo, da uredba ni zadostila ciljem, kar je tudi razvidno v nadaljevanju magistrskega dela. Zaradi tega je Komisija sprejela Predlog o spremembi Uredbe 861/2007, v kateri je bilo nekaj predlogov, ki niso obrodili sadov in predlogi, ki so dobili podporo s strani Evropskega parlamenta in Sveta. Slednja sta sprejela Uredbo 2015/2421 o spremembi Uredbe 861/2007, ki naj bi s številnimi popravki, med njimi najbolj pomembnim glede višine vrednosti zahtevka, povečala število zahtev v evropskem postopku v sporih majhne vrednosti in omogočila bolj učinkovit postopek. Spremembe so podrobneje predstavljene v nadaljevanju magistrskega dela. The master’s thesis is focused on the principles of the small claims procedure, which is at the level of our national law, regulated by Civil Procedure Act (hereinafter CPA) as well as at the European level regulated by Regulation no. 861/2007. Towards the end of the thesis follows the comparison of the two procedures. This procedure is special because of the low value of the claim, amounting 2.000 euros and this is exactly why the principles in this specific procedure differ from the principles of ordinary procedure. Regardless to adjusting the principles and simplicity of the procedure in small claims, it is not reduced the quality of legal protection. In addition to the internal litigations, there are also many cross-border litigations, because more and more people use online purchases what increases the number of cross-border litigations. In order to enhance access to justice, was the European Union adopted Regulation no. 861/2007 establishing a european small claims procedure, which simplifies and speeds up the cross-border small claims procedures. Over time, however, it became clear that the regulation was not sufficient, which is also shown below the thesis. For this reason, the Commission adopted a Proposal amending Regulation no. 861/2007, in which there were some proposals, that have not been fulfilled and proposals that have been supported by the European Parliament and Council. The latter adopted Regulation no. 2015/2421 that amending Regulation no. 861/2007, which should, with many corrections, among them the most important about the value of the claim, increases the number of claims in the european small claims procedure and allows more efficient process. The changes are presented in more detail in the following of thesis.
