Popis: Zemljiškoknjižno pravo predstavlja enega izmed pomembnih vidikov nepremičninskega prava. Temeljna zakona na tem področju sta Zakon o zemljiški knjigi (ZZK-1) in Stvarnopravni zakonik (SPZ). Zakonodaja je utemeljena na posebnih načelih, ki so vključena v zakon in dajejo smernice za interpretacijo posameznih določb. Najpomembnejša evidenca v zemljiškoknjižnem pravu je zemljiška knjiga, ki je tesno povezana z zemljiškim katastrom. Zemljiško knjigo vodijo okrajna sodišča, namenjena pa je vpisu in javni objavi podatkov o pravicah na nepremičninah in pravnih dejstev v zvezi z nepremičninami. Glavne oblike vpisa so vknjižba, predznambe in zaznambe. Osrednjo temo tega diplomskega dela predstavlja pravni institut zaznambe. Gre za glavni vpis, s katerim se opravi vpis oziroma izbris pravnih dejstev. Izrednega pomena je, ker se z njo doseže objava določenih pravno pomembnih dejstev ali osebnih lastnosti imetnika, kar je zlasti pomembno z vidika varstva strank, ki poslujejo z nepremičninami. Zaradi javne objave postane to pravno dejstvo razvidno vsakomur (publicitetni učinek), zaradi česar se nihče, ki je pridobil knjižno pravico za tem, ko je že učinkovala zaznamba, ne more sklicevati na to, da zanj ni vedel. Land register law represents one of the significant aspects of property law. The two main acts from this field are the Land Register Act (ZZK-1) and the Law of Property Code (SPZ). The legislation is based on specific principles which are included in the act and give the guidelines for the interpretation of individual articles. The most important records of land register law can be found in the Land register, which is tightly connected to the Land cadastre. The local courts have jurisdiction over the Land register, which is intended for the registration and publication of data on property rights and legal facts pertaining to property. The main forms of registration are entries, prenotations, and notations. The focal point of this thesis is the institution of notation, which is the main entry employed for entering or deleting legal facts. It plays a vital role, since it is the basis for the publication of specific legally significant facts or personal characteristics of the holder. The latter is important especially from the perspective of protecting the parties dealing with properties. Due to the public notice this legal fact becomes accessible to everyone (publicity effect). This makes it impossible for anyone, who was granted the land register right after the notation already came into effect, to claim that they did not know about the existence of the mentioned legal fact.
